The process of becoming a U.S. citizen is called Naturalization. The United States grants citizenship to a foreign national after he or she fulfills the requirements established by Congress in the Immigration and Nationality Act (INA). Our naturalization lawyer in San Diego will guide you and explain every requirement in a manner that will make you feel confident through the process.

 

First, you need to make sure that you are eligible to apply for naturalization; you may qualify if:

  • You have been a permanent resident for at least 5 years.

  • You are the spouse of a U.S. citizen and have been a permanent resident for 3 years or more.

  • You have qualifying service in the U.S. armed forces.

  • You are a U.S. citizens’ child born outside the United States

U.S. Citizenship Through Naturalization

The road to naturalization may be uncertain, but worth every moment.  If you decide to become a citizen of the United States, we will be happy to advise you with regards to your eligibility, naturalization application, provide you with resources for the civics examination, attend the interview with you, and be there for you at every step to make sure that your naturalization process is smooth and stress-free.

 

Generally, to be eligible for naturalization you must:

  • Be age 18 or older

  • Be a permanent resident for a certain amount of time (usually 5 years or 3 years, depending on how you obtained status)

  • Be a person of good moral character

  • Have a basic knowledge of the U.S. Government (a waiver can be obtained in certain circumstances).

  • Have a period of continuous residence and physical presence in the United States

  • Be able to read, write, and speak basic English. There are exceptions to this rule

 

Certain members of the military, and their spouses, may be able to file for naturalization sooner than noted above.

 

USCIS provides information about naturalization (USCIS resource here), but sometimes their guides are confusing or lack information. Answering all the questions on the applications can be confusing and take a lot of time, and the interview process can be very stressing. Do not get discouraged, it is possible to become a citizen if you are sure you sent the correct paperwork and are fully prepared for your interview.

  • Review if you can obtain a waiver for the language test requirement.

  • Address any changes to your job, if your permanent residency is based on a work visa.  

  • Review your marital status if it changed while you were a permanent resident.

  • Review the time spent outside of the U.S. while on vacation or for work reasons, if the time was extensive.

  • Review your tax situation before filing the petition.

  • Identifying grounds for claiming derivative citizenship or acquired citizenship based on family circumstances (if applicable).

N-400 Vs N-600

The Form N-400 is the “Application for Citizenship,” and the Form N-600 is the “Application for Certificate of Citizenship”, used for a child under 18 years old. These forms are filed through the United States Citizenship and Immigration Services (USCIS).
